Invitational Series and it’s events are hosted by DYSports LLC.

This Privacy Policy sets forth the terms on which DYSports, LLC (“DYSports”, “we”, “us”, “our”) collects, uses, and otherwise processes personal information from users of, participants in, or visitors to, the Site, Shop, Sporting Events, Camp Activities, and other services provided by DYSports which reference our Terms of Use (collectively, the “Services”). This Privacy Policy is incorporated into and forms a part of the Terms of Use (“Terms”), together with all other terms and policies linked or otherwise referenced within the Terms or this Privacy Policy. Capitalized terms used and not otherwise defined in this Privacy Policy shall have the meanings provided in the Terms.

Please read this Privacy Policy carefully before using the Services or purchasing our products. We allow users to agree to our Terms by accessing or using the Services, purchasing our goods, or by signing, checking a box, or clicking a button indicating acceptance of the Terms or of a registration form, addendum, invoice, and/or other written agreement(s) between DYSports and you which incorporates this Privacy Policy or the Terms by reference. By indicating your acceptance of the Terms, you agree to be bound by the Terms (which include this Privacy Policy).

We may revise and update this Privacy Policy at any time in accordance with the Terms. The “Last Updated” date provided at the top of this page indicates the date on which we posted the most recent version of this Privacy Policy. If you have registered for an account to use the Services, we may also notify you of changes to this Privacy Policy by sending a notice to the primary e-mail address specified in your account. We encourage you to review this Privacy Policy whenever you visit the Services to make sure that you understand how your Personal Information is being processed.

DEFINITION OF PERSONAL INFORMATION

As used in this Privacy Policy, "Personal Information" means information that can be used to identify an individual, the processing of which is subject to applicable data privacy laws. The term “Personal Information” can include information such as your name and e-mail address, but can also include indirect identifiers such as your IP address or device identifier. The term “Personal Informationdoes not include aggregate information, which is data we collect about the use of the Services or categories of such users unless it is linked with your other Personal Information.

DATA THAT WE COLLECT

To use the Services, you may need to submit, or we may collect, Personal Information of various Participants in our Sporting Events and Camp Activities, as well as parents of Participants, team coaches, and attendees. Our purposes for using or otherwise processing the foregoing Personal Information are described in the section titled “Our Uses of Personal Information” below. By providing Personal Information to DYSports for processing, you affirm that you have provided all notices and obtained all consents necessary under applicable data protection laws to permit DYSports to process such Personal Information for the purposes described in this Privacy Policy.

Generally, you may provide us with two categories of data: User Data and Services Usage Data. The types of information that you may provide in each category, along with the technologies that we use to collect such information, are generally described in the sub-sections below.

User Data

User Data” is the Personal Information that you provide when you register Participants for our Sporting Events and Camp Activities, sign up to receive the Services, send us messages in connection with the Services, or submit Personal Information for processing by the Services. Any User Data that we receive about you is provided directly by you, or on your behalf, on a voluntary basis. We describe the most common types of User Data that you may expect to provide below:

  • Use of the Services. You will be required to provide Personal Information to use or access certain tools and features of the Services. If you register for an account for the Services, you may be required to provide us with Personal Information such as your contact information, including your full name and e-mail address. Additionally, our Service Providers (as defined below) may collect and process additional Personal Information when you use or interact with the functions that they provide. For example, DYSports Apparel—our Shop which offers DYSports-themed gear and apparel—is supported by our Service Providers; those Service Providers will collect Personal Information such as payment information when you enter it into the Services in connection with a transaction in order to process payments for our products.

  • We may also collect and process analytical and statistical data regarding your use of the Services, such as bug/crash reports, to enable us to maintain, develop, and improve the features and performance of the Services, and otherwise for the purposes described in this Privacy Policy.

  • Communications with DYSports. When you send e-mail messages to DYSports, we may receive Personal Information about you, and may use the information that you provide to respond to your communication and/or as described in this Privacy Policy. We may also archive this information and/or use it for future communications with you where we are permitted by law to do so.

  • Automatically Collected Information: When you visit, use, and interact with the Site, we automatically collect data about those visits, uses, or interactions. We may use analytics service providers, including Google Analytics, to collect information regarding visitors to the Site, such as their behavior on the Site or information about their demographics. Information collected may depend on the type of device you use and its settings; however, the types of information that we collect may include the following:

    • Usage and Engagement Data: Metadata about your activities on and use of the Site, such as the types of content that you view or engage with, the features you use, and the actions you take, as well as your time zone, country, the dates and times of access, user agent and version, type of computer or mobile device, computer connection, your IP address.

    • Log Data: Information that your browser automatically sends whenever you visit the Site, such as your IP address, browser type and settings, the date and time of your request, and how you interacted with the Site.

    • Device Information: Name and model of your device, the operating system used, and (if you access the Services via a web browser) the browser that you are using.

You are responsible for verifying the accuracy of the Personal Information you submit to the Services, whether on your own behalf or behalf of a third party, and ensuring that any Personal Information that you provide (directly or indirectly) is kept up to date for the purposes for which you provide it. Inaccurate information may affect your ability to use the Services, the information you receive when using the Services, and our ability to contact you.

Some Personal Information that you submit can be removed at any time upon your request. Note, however, that some Personal Information is necessary to use the Services. As such, even if you remove all Personal Information from your account, we may retain some of your Personal Information to comply with our legal obligations or as necessary to provide the Services to you.

Services Usage Data

We, as well as our Service Providers (defined below), automatically track and collect certain types of information about visits to and use of the Site (“Services Usage Data”), such as your IP address, geolocation data, device identification, browser type, and operating system, as well as the referring or exit pages, the page(s) requested, and cookie information. We do not treat Services Usage Data as Personal Information if it does not identify you and is not directly linked to your Personal Information.

We may use information about you to create and use anonymous, pseudonymous, statistical, or aggregated data (collectively, “Aggregated Data”). Such Aggregated Data does not allow another party to identify you or any other specific user, and is not Personal Information subject to this Privacy Policy.

HOW WE COLLECT PERSONAL INFORMATION

In addition to Personal Information that you submit directly to the Site or Services, or in communications with us, we collect Personal Information from the following sources:

  • Sporting Events/Camp Activities. We may collect Personal Information relating from attendees on site at the Sporting Events and Camp Activities that we organize, manage, hold, or otherwise administer as part of providing the Services, such as Participants, parents or guardians of Participants, coaches, referees, administrators, or volunteers at the Sporting Event or Camp Activities.

  • Service Providers. We may receive Personal Information that you submit directly to our Service Providers in connection with registration for Sporting Events or Camp Activities. For example, as part of the registration and administration process, we may share with, or receive from, our Service Providers the Personal Information submitted by or on behalf of Participants in connection with their participation in the Sporting Event or Camp Activity (such as name, birthdate, height, addresses, phone numbers, email addresses, or other demographic data), as applicable.

All such Personal Information is processed for the purposes described in “OUR USES OF PERSONAL INFORMATION” below.

OUR USES OF PERSONAL INFORMATION

We use Personal Information that we collect from you to process your requests, to facilitate your use and our administration and operation of the Services, to provide you with information or services you request, and to learn more about and improve the Services, including by:

  • verifying the eligibility of, and registering, the Participants included in your submission in Sporting Events or Camp Activities, or otherwise administer as part of the Services;

  • maintaining a list of verified and eligible participants for our Sporting Events and Camp Activities;

  • establishing and managing your use of the Services;

  • sending you account-related e-mails;

  • responding to your e-mails, submissions, comments, requests for technical support or assistance, or complaints;

  • developing, customizing, and improving the Services, and the resources that DYSports provides (including without limitation diagnosing technical and service problems, administering the Services; managing our communications; and analyzing and enhancing the Services; protecting the security of our networks and information systems);

  • identifying and protecting against fraud, prohibited or illegal activities, as well as potential third-party claims and other liabilities;

  • providing, supporting, personalizing, and developing the Site and related Services;

  • personalizing your experience with the Services and delivering product and service offerings relevant to your interests;

  • conducting testing, research, analysis, and service development;

  • protecting the rights, property or safety of Participants, volunteers, attendees, officials, staff, or other individuals in our Sporting Events and Camp Activities; and

  • generally complying with applicable laws, rules, and regulations.

Cookies; Do-Not-Track Signals

We, and our Service Providers, use a variety of online analytics products that automatically deploy cookies, pixel tags, local storage, and other technologies to collect information through the Services to help us with analyzing how users use the Services.  A “cookie” is a piece of data sent to your browser by a website you visit. Depending on the type of information collected, cookies may constitute Personal Information. Depending on your device specifications and settings, you may be able to configure your browser to accept all cookies, to reject all cookies, or to notify you whenever a cookie is offered so that you can decide each time whether to accept it. Note that refusing a cookie may in some cases preclude you from using, or negatively affect the display or function of, a website or certain areas or features of a website.

Our use of cookies and other automatic technologies falls into the following categories:

  • Strictly Necessary: Technologies that allow you to access the Services and use our features, and tools that help us identify irregular site behavior and prevent fraudulent activity or improve security.

  • Functionality: Technologies that collect information about your use of the Services, including measuring, understanding, and reporting on your usage of the Services. We may use these cookies to measure the effectiveness of that content, including information about what content was shown, how often or how long it was shown, when and where it was shown, and what actions, if any, you took on the content.

  • Performance: Technologies that store information or provide access to information that is already stored on your device, such as when you have logged into the Site previously.

  • Marketing/Advertising: Technologies that collect information about your use of the Services, including measuring, understanding, and reporting on your usage of the Services. We may use these cookies to personalize your experience with the Services, and to deliver content and product and service offerings relevant to your interests, including targeted offers and ads through the Site, third-party sites, and via email (with your consent where required by law).

Opt-Outs

You may be able to opt out of providing certain categories of Personal Information to us by following the instructions below. You may stop or restrict the placement of cookies on your device or remove them as your browser or device permits. Note that some browsers have incorporated “Do Not Track” (“DNT”) features that can send a signal to the websites you visit indicating you do not wish to be tracked. As of the date on which this Privacy Policy was last updated, however, there is no standardized DNT signal. As such, the Services do not currently respond to browser DNT signals.  If you do not wish to be tracked, you may be able to opt out by selecting certain options in the settings of the browser or device that you use to access the Services, or by using third-party applications and programs.

SHARING OF PERSONAL INFORMATION

DYSports does not process the Personal Information that you provide except as required to provide the Services to you, as specified in this Privacy Policy, with your consent, or as otherwise permitted by law. A non-exhaustive list of examples of our sharing of Personal Information are described below:

  • From time to time, we may share Personal Information with consultants, vendors, and service providers (“Service Providers”) who assist us in providing the Services and related services. These Service Providers may include vendors and suppliers that provide us with technology, services, and/or other content related to the operation and maintenance of the Services. Our Service Providers may access the categories of Personal Information specified in the section “User Data” to the extent necessary to provide their products or services to us.

  • From time to time, DYSports may partner with third parties that offer information, coupons, special discounts, contests, games, promotions, and special events related to your use of the Services. We may provide limited Personal Information to these entities related to their collaborations with us on promotions, events, special offers, and other joint projects. The use of the Personal Information that you submit by such third parties may also be governed by these third parties’ privacy policies.

  • DYSports may share Personal Information submitted under this Privacy Policy with government authorities in the scenarios described below. In such cases, we reserve the right to raise or waive any legal objection or right available to us at our discretion:

    • if we are required by law, regulation, or legal process (such as a court order or subpoena), including in response to requests from public and government authorities outside your state of residence or to protect our rights, privacy, safety or property, or that of you or others anywhere we conduct business;

    • in response to requests by government agencies, such as law enforcement authorities; and/or

    • if we have a good faith belief that the disclosure is necessary or appropriate to comply with law or legal process.

  • We also may share Personal Information when we believe it is appropriate to investigate, prevent, or take action regarding illegal or suspected illegal activities; to protect and defend the rights, property, or safety of DYSports, the Services, our users, or others; to prevent and protect DYSports and its users from fraudulent, abusive, unlawful, or unauthorized use of the Services; to otherwise enforce our rights and agreements; and otherwise in connection with our Terms and other agreements with you, in each case as permitted by applicable laws.

  • We reserve the right to disclose or transfer any information we have about you as part of, or during negotiations of, any merger, sale of company assets, or acquisition, or in any other situation where Personal Information may be transferred as one of DYSports’ assets.

We will not collect additional categories of Personal Information or use the Personal Information that we collect for materially different, unrelated, or incompatible purposes without providing notice to you.

PROTECTING PERSONAL INFORMATION

We take reasonable measures to protect Personal Information from misuse, interference, and unauthorized loss, access, modification or disclosure. We undertake industry standard data protection practices, including by deploying a variety of commercially available software and hardware security tools. We will take such measures with respect to Personal Information you submit using security measures that we use for Personal Information of others, and we will do so in compliance with all applicable data protection laws and our professional secrecy and ethical obligations of which we are aware. Unfortunately, despite such measures, no data transmission over the Internet and no database or other depository of information can be one hundred percent secure. As a result, while we will strive to protect Personal Information, we cannot and do not guarantee or warrant the security of any Personal Information. We will not be and are not liable for disclosures of Personal Information due to errors in transmission, networks that we do not control, or unauthorized acts of third parties.

To protect the confidentiality of the Personal Information that you submit, you must keep the Personal Information associated with your account confidential and not disclose it to any other person. You are responsible for all uses of the Services by any person using your account.

YOUR RESPONSIBILITIES; OPTING OUT OF COMMUNICATIONS

You acknowledge and agree that you, not DYSports, are solely responsible for the accuracy, quality, integrity, legality, reliability, appropriateness, and intellectual property ownership or right to use of all Personal Information that you submit, and for ensuring that any Personal Information that you provide is kept up to date for the purposes for which you provide it. Inaccurate information may affect your ability to use the Services, the information you receive when using the Services, and our ability to contact you.

We only send promotional e-mails to persons who have provided their e-mail addresses directly to us and who have consented to receive communications from us. If you do not wish to receive or you are inadvertently sent promotional e-mails from DYSports, you may opt out by contacting us using the information provided at the bottom of the page, or by clicking the “unsubscribe” link at the bottom of each promotional e-mail. Please note that even if you opt out of receiving e-mails from DYSports, you may still receive relationship e-mails from us, including responses to e-mails that you send to us, notices of updates or changes to our policies and procedures, or other messages relating to your account or your use of the Services.

Except as otherwise expressly discussed in this Privacy Policy, this Privacy Policy only addresses DYSports’ use and disclosure of Personal Information we collect from you. This Privacy Policy does not address, and DYSports is not responsible for, the policies and practices of third parties with respect to Personal Information that you disclose to such third parties through or in connection with your use of the Services. This includes any third party operating a site or service to which the Services may link. We encourage you to ask questions or review their privacy notices or policies before you disclose any Personal Information to such third parties. The inclusion of a link to a third party’s site, services, products, or other offerings in the Services does not imply endorsement of the linked third-party site or service by DYSports.

Subject to local law, you may have certain rights regarding Personal Information we have collected about you. Such rights might include the right to (a) know what Personal Information we have collected about you, (b) know what Personal Information about you was disclosed to third parties, (c) update or correct such information if you believe there is an inaccuracy, (d) restrict the processing of your Personal Information, (e) request deletion of your Personal Information, (f) object to our use of your Personal Information, or (g) request transmission of your Personal Information to another data controller. We will not discriminate against you for exercising any of these rights, except that the deletion of your Personal Information may prevent us from providing you content, invitation, or benefit that depends on the processing of your Personal Information.

Please note that for certain requests we may ask you, or your agent making a request on your behalf, for identity verification and permission in a manner permitted under local law.

Complaints will be investigated and the outcome of the investigation will be communicated to you after the complaint is made in accordance with legal requirements. You may also have a right in some locations to file a complaint with your local data protection authority.

INFORMATION RETENTION AND DELETION                                                       

Personal Information that we collect will be processed in accordance with this Privacy Policy and our internal retention guidelines. We will retain the Personal Information that you provide for as long as necessary to fulfill the purpose(s) for which it was collected, such as to enable or improve your access to or use of the Services. You may submit a request to review or delete the Personal Information that you submit to the Services for processing by contacting us using the contact information provided in the “Contact Us” section below. Note, however, that we will keep Personal Information until such time as we no longer expect to need to use it for any legal and legitimate purpose and otherwise in accordance with all applicable laws. At the appropriate time, we will take reasonable steps to destroy Personal Information or ensure that Personal Information is de-identified, except were we need to retain such information to satisfy legal obligations.

SPECIAL NOTICES REGARDING CHILDREN UNDER 13

DYSports does not sell the Services or its products for purchase by children. While we provide Sporting Events and Camp Activities for children, the Site is not expressly designed for use by children under the age of 13. If you are under 18, please do not attempt to register for the Services online or send any Personal Information about yourself to us, you may use the Services only with the involvement of a parent or guardian. DYSports does not knowingly collect any Personal Information from children under the age of 13 without the consent of the child's parent or guardian. Additionally, we will not collect more Personal Information regarding children under 13 than is necessary for them to participate in and otherwise use the Services other than the Site.

REGARDING OUR EXEMPTION FROM INTERNATIONAL AND STATE DATA PRIVACY LAWS

As of the “Last Updated” date indicated on this page, DYSports does not conduct business (and declines to so conduct business) and is therefore not subject to the data privacy laws of the European Union or the state-level data privacy laws of the United States, including Colorado, California, Connecticut, Montana, Oregon, Utah, or Virginia. All information processed by us may be transferred, processed, and stored anywhere in the world, including, but not limited to, the United States or other countries, which may have data protection laws that are different from the laws where you live. We endeavor to safeguard your Personal Information consistent with the requirements of applicable laws.
